Head of Compliance (PCF12) & Head of Anti-Money Laundering and Counter Terrorist Financing (PCF52)

The Head of Compliance (PCF12) & Head of Anti-Money Laundering and Counter Terrorist Financing (PCF52) will hold overall accountability for overseeing the compliance function (including AML / CTF & Sanctions compliance) and report directly to the Board, relevant Board committee, or both, on compliance, AML / CTF & Sanctions compliance issues. This individual will act as the main point of contact for all daily concerns, inquiries, and advice related to the Irish depositary business. Specifically, the role involves ensuring secondary supervision of the TSL outsourcing and AML / CTF frameworks. The role also entails managing the CBI relationship and all CBI inspections and evaluations. Furthermore, the role encompasses reporting to and attending various TSL governance committees, in addition to serving as the Data Protection Officer and Anti-Fraud Officer for TSL.

As a Pre-approval Controlled Function, this position is subject to the Central Bank of Ireland's Fitness & Probity standards.

Duties include:

Compliance Policy, Process and Documentation

  • Manage the creation of compliance policies and offer assistance to business units regarding the effects of business advancements on policy
  • Supervise the yearly AML / CTF / Sanctions Business Risk Assessment and ensure suitable corresponding policies and procedures
  • Lead the AML/CTF & Sanctions compliance function to address TSL's money laundering, terrorist financing & sanctions risks by establishing and overseeing a robust AML/CTF/Sanctions framework; overseeing the implementation and efficient application of AML/CTF/Sanctions systems and controls
  • Provide oversight on the review of customer complaints
  • Supervise the review and tracking of employee disclosures concerning personal trading, external business activities, etc.
  • Oversee and review incidents related to data loss or potential data loss
  • Review findings from regulatory consultant to independently identify and resolve issues following established guidelines, considering internal guidelines as well as external regulatory requirements
  • Carry out a variety of intricate tasks and analyses, including discussing proposed solutions with Compliance management
  • Convey compliance and regulatory obligations in both written and verbal formats to management
  • Proactively identify patterns in recurring compliance breaches and inquiries, collaborating with other team members to enhance compliance procedures and processes, training materials, and forms
  • Document changes in compliance obligations. Ensure reporting on the impact of these changes to the line of business and compliance management globally
  • Manage the compliance reporting process to TSL senior management and board (including AML / CTF / Sanctions matters)
  • Coordinate regulatory projects, meet deadlines as per schedule, and produce management information related to the project
  • Review regulatory submissions and guarantee their timely submission
  • Assist in responding to requests for information from CBI, gather information and documentation, and prepare the appropriate response for Compliance management
  • Maintain regular review of the Compliance manual for your area and keep it updated with regulatory modifications

Compliance Advice, Issue Identification / Escalation and Business Planning

  • Engage with senior management on modifications to business procedures in relation to compliance policies
  • Ensure constant upkeep of compliance procedures, ensuring completeness and up-to-dateness of procedures
  • Spot regulatory concerns that might affect local business and collaborate closely with the business to resolve such concerns
  • Identify AML/CFT/Sanction regulatory matters that could impact local business and liaise with the Global Financial Crimes Compliance Department on the implications of these matters
  • Communicate with Risk Management regarding related topics to ensure appropriate coordination for the second line of defense
  • Offer sound technical advice to the business when needed, along with solutions for complex regulatory matters
  • Provide Action Plans recommendations and implement them effectively

Compliance Problem Resolution

  • Identify and resolve problems independently following established procedures, taking into account internal guidelines and external regulatory requisites
  • Undertake an array of complex tasks and analyses, including deliberating proposed solutions with Compliance management
  • Convey compliance and regulatory requirements clearly through written and verbal communications to the management
  • Proactively identify trends in recurring compliance breaches and inquiries, working with team members to enhance compliance procedures and processes, training materials, and forms

Compliance Team, Supervision, Training, Management, and Business Training

  • Oversee the assignment of daily tasks to members of the Dublin Compliance team when necessary and collaborate locally and globally with the wider Compliance team when required
  • Create training materials and conduct employee training for the business (with support from the business as deemed necessary)
  • Ensure training topics align with current Compliance priorities and update training materials to reflect regulatory changes
  • Offer training and assistance to other members of the Compliance team

Compliance Monitoring

  • Work with team members to ensure the compliance monitoring program stays on course and that relevant compliance processes are suitably documented
  • Responsible for addressing and closing outstanding action points identified through the compliance monitoring program
  • Undertake compliance monitoring program activities as needed
  • Assess and document findings from the compliance monitoring program, including completing all necessary working papers, notes from meetings, visit summaries, and other compliance monitoring records following the compliance monitoring framework
  • Review reports on findings before distributing them to business managers
  • Ensure the compliance monitoring control schedules are regularly updated
  • Establish and sustain the Compliance Risk Assessment for your business area, as applicable
  • Develop and uphold an annual Compliance Monitoring Plan for your business area, as required
  • Ensure cooperation with Internal Audit when planning compliance monitoring

Compliance Operations

  • Execute compliance operations processes as necessary
  • Strive to streamline processes and enhance efficiency
  • Analyze Compliance team workflows to optimize operational efficiency
  • Compare local Compliance procedures with current regulatory requirements and introduce any necessary new technology that the department may need

REQUIREMENTS:

  • Business / Finance / Law Degree and / or equivalent work experience
  • 10+ years of experience in business or compliance (current PCF role holder preferred)
  • Demonstrated leadership abilities
  • Excellent written and verbal communication skills
  • Proven technical compliance expertise concerning Irish Fund Service Provider regulatory compliance
  • Ability to handle a variety of complex tasks and analyses
  • Consistent compliance with the Central Bank of Ireland's Fitness & Probity requirements
  • Proficiency in the financial services sector and current regulatory requirements pertaining to the Fund industry, including Alternative Funds, and related support functions such as depositary services
  • Understanding of relevant Irish banking or fund laws and regulations (not just procedure comprehension)
  • Experience and knowledge of laws and standards related to AML/KYC, Data Protection, Outsourcing, and Anti-Fraud regulations
  • Experience and skills in dealing with Clients / Regulators will be advantageous
