Role description:

Arcadis' independent Compliance Function, led by the Global Compliance Officer and supported by the Compliance Officers (COs), the Global Compliance Committee, and other Global Business Area (GBA)- and Country Compliance Committees, is responsible for providing support and expert advice to the Arcadis group on all integrity and compliance-related matters, and monitors whether the Arcadis General Business Principles (AGBP), Integrity and Compliance expectations are met. 

The Compliance Counsel provides expert advice on aspects of the law relating to third-party risks, including Sanctions and trade compliance, Know Your Client (KYC), Anti-Money Laundering (AML), Sustainable value chain, and Environmental Social Governance (ESG). This role is accountable for providing strategic advice, actionable guidance, and training on existing and new regulations and risks for the Arcadis Group.

The Compliance Counsel reports directly to the Global Compliance Officer. The Compliance Counsel has no direct reports but will as a member of the Global Compliance team be enabled and expected to build a collaborative network of stakeholders.

This is a global role, the position can be filled in any location in GBA Countries.

Role accountabilities:

Add value through leveraging global expertise and act as a business partner

The Compliance Counsel is a key subject matter expert on compliance laws and a member of the Compliance Function with specific focus areas from the Global Integrity & Compliance Program and aligned with the Integrity & Compliance Management System, in particular:

Risk assessments/Due diligence covering Sanctions and trade laws, AML, KYC, Sustainable value chain, and ESG. Real-time advice and policy drafting on emerging regulatory issues and escalations.  Contribution to the Standardization & Automation initiatives and special projects in close collaboration with the Business Process Community (BPC) for the compliance-related processes owned by the Global Compliance Officer. ESG/Non-Financial or Corporate Sustainability due diligence and reporting.

The Compliance Counsel will work closely with the Legal, Compliance & Privacy Functions (LCP) and its stakeholders. In particular, this role will closely collaborate and support with subject matter expertise the Global Compliance Officer, Director Compliance Counsel, GBA/country level Compliance Officers, the Compliance Global Shared Services Centre (GSSC) team, the Enabling Functions, Finance (incl. Non-Financial Reporting), Growth (including Pursuit, and Sustainability) and Delivery (including Pursuit, and Procurement), Business Process Board (BPO), Strategy, the Know Your Third Party (KY3P) core team and the GSSC centralized screening team (being set up).

Arcadis has identified the following key focus areas and responsibilities for the role:

Provide expert support for Compliance/Third Party Risk Assessments/Due diligence and related controls that are part of the Arcadis Risk and Control Framework (ARC Framework) and act as a business partner to the business, the Pursuit Process, Enabling Functions, and Compliance Officers. Provides expert support on processes and procedures and enables the Compliance Officers, the business, and Enabling Functions with compliance advice. Monitor compliance laws, regulatory trends, developments and best practices, and know-how sharing, develop FAQs, and draft policies. Identify awareness & training needs based on lessons learned and otherwise, providing expert input on global training programs and micro-learnings and design content of global training and micro-learnings. Provide expert support on developing and implementing ARC Framework-controlled documents / Compliance-related policies, procedures, contract templates, notices, and controls, due diligence. Provides expert support on corporate sustainability reporting and due diligence requirements. Provides follow-up and consultation to project stakeholders to ensure successful delivery of program requirements. Manage the compliance-related business processes in support of the Global Compliance Officer (Compliance BPO owner) to ensure consistent global ways of working and in close collaboration with the other BPOs and the BPC and Pursuit Process related to the focus areas of this role. Provide expert input on change management and communication programs in related to the focus areas of this role.

Accountability, Culture & Compliance

Role Model Integrity by design, the AGBP, the ARC Framework, and Regulatory and Policy Compliance and the related controls. Act as a visible steward of Integrity & Compliance, Compliance Business Processes and Compliance quality management, core values and behaviors. Safeguard compliance with relevant laws and regulations, increase awareness, and provide or signpost additional training where needed. Provide front-line advisory and establish trusted and influential relationships. Implement the overall LCP Functions Strategy through effective expertise in the organization and delivery of sustainable solutions in line with BPO processes.

Qualifications & Experience:

The candidate must have a demonstrated high level of integrity and discretion. The candidate should have an academic bachelors or masters degree, a minimum of 7+ years progressive compliance experience in a compliance or legal capacity, and be qualified to practice law. The candidate should have broad international experience and understand the complexity of conflicting local laws, with cultural sensitivities and an eye for local needs.

Further, the candidate should have:

Proven experience in laws relating to Sanctions, AML, KYC, value chain, ESG, and best practices and understanding the priorities and needs of the business and Arcadis risk profile. Excellent understanding of the regulatory landscape in which large multinational companies like Arcadis operate. Desire to drive operational compliance excellence through the global LCP function and embedded throughout the business, including motivating and engaging with networks and diverse teams and with a technology-innovative mindset. High level of communication skills and expertise in consulting, coaching, and presenting in a clear and concise manner and with a sense of humor.
