The Property Lawyers are responsible for the acquisition of property and interests required for the purpose of road, greenway and rail projects, the registration of TII's interests and the legal agreements necessary for the exploitation of TII's property assets, including, where required, leases and licences, development agreements and general legal, environmental and planning issues.

TII is presently at the planning stages of the MetroLink project, which will connect key destinations including Dublin Airport and the City Centre along the current proposed route. An application for a Railway Order for MetroLink was made in September 2022 and an oral hearing before An Bord Pleanála concluded in March 2024. External legal advisors have been appointed to provide project advices and support to MetroLink, however the in-house team also supports the project as required and acts as an interface between the MetroLink Team and external legal service providers Commencing in 1999, TII (then RPA) constructed the original Red and Green Luas Lines in Dublin, as well as extensions to the Docklands (Point) and Broombridge (Luas Cross City Project).

There are legacy property matters outstanding from the construction of these original lines. The successful applicant will assist with the closing out of these matters and with the anticipated increased requirement for legal support relating to the Luas Finglas project and other planned light rail projects, as well as ongoing work to support the operation of existing infrastructure and management of TII property assets.

Duties and responsibilies:

  • Advising on property-related agreements put in place for MetroLink, Luas Finglas and other TII projects including conducting negotiations on behalf of TII.
  • Acquisition of property interests under the compulsory purchase process set out in the various Roads and Transport Acts, or by private agreement.
  • Legal management role, as required in TII projects, involving developing a suitable understanding of the project as it develops and of regulatory and legal issues that affect it.
  • Provision of general legal advice on regulatory issues that arise from time to time, including levy schemes and environmental and planning matters.
  • Provision of advice on exploitation of infrastructure, as business ancillary to TII's core business, including third party licence agreements, development agreements and leases.
  • Registration of TII's title in a timely manner, including dealing with all PRAI queries, and maintaining a register of property interests and registration details.
  • Advising on general property rights and protection of such rights.
  • Supporting the planning and development of TII projects and programmes as necessary.
  • Advising on matters of statutory and/or regulatory interpretation relating to TII's powers and obligations.
  • Reviewing draft legislation relevant to the interests and functions of TII and co-ordinating, contributing to and drafting submissions on such legislation on behalf of TII.
  • Undertaking such tasks, activities or other duties as may be required or assigned appropriate to the grade.

Education and experience:

The successful candidate will be required to demonstrate the key competencies for a Grade 1 position as identified in Appendix A, as well as the following job-specific requirements:

  • Candidates must be professionally qualified solicitors with strong academic qualifications, and excellent commercial awareness.
  • 7 years post graduate experience in property law is required. Experience in commercial law, planning and environmental law, construction law, projects or a related area is desirable.
  • Exceptional analytical and communication skills with focus on making complex legal concepts clear to non-legal audiences.
  • Ability to work effectively as part of multi-disciplinary teams with colleagues and external advisers from diverse backgrounds and at all levels of the organisation.
  • Strong legal research, statutory/regulatory interpretation and writing skills required.
  • Highly organised with attention to detail.
  • Strong interpersonal skills.
  • Report writing and presentation skills required.
